THIS MATTER, a complaint filed by Sammy Jolly (Complainant) with the Iowa Civil Rights Commission (Commission) charging VENETIAN IRON WORKS, INC. (Respondent) with discrimination in employment on the basis of race came on for Hearing in Des Moines, Iowa on May 25, 1988, before Ione G. Shadduck serving as Hearing Officer. The case in support of the complaint was presented by Rick Autry, Assistant Attorney General. Neither the Respondent nor an attorney for Respondent appeared. Attorney Autry submitted a letter dated May 13, 1988, from Kenneth G. Butters, Attorney for Respondent, stating that neither he nor any representatives of

Venetian Iron works, Inc., would be attending the Hearing. (Complainant's Exhibit 2). Attorney Autry understood that Respondent intends to dissolve the corporation. On that basis Attorney Autry moved for a default judgment against Respondent.

Under Iowa R. Civ. P. 23 (c) Venetian Iron Works, Inc., was declared in default for failure to appear for Hearing.

The Hearing Officer requested to hear and receive evidence upon which judgment could be based pursuant to Iowa R. Civ. P. 232(b).
