DECISION AND ORDER
Prudential Insurance Company
of America violated Iowa Code 601A.7 (1985), in refusing to accept
Doris A. Carruthers' application for insurance because her principal
source of income was from public assistance.
1. IT IS ORDERED that Prudential
shall process Carruthers' application as of January 14, 1985,
as specifically set forth in Complainant's Exhibit 4, and pay
all premiums to the date of the final decision in this case so
that all benefits of the policy are as they would have been if
the application had been accepted on that date.
2. IT IS FURTHER ORDERED
that Prudential shall change their policy to allow persons on
public assistance to obtain insurance based on the same consideration
as persons not on public assistance. Proof of this policy change
shall be submitted to the Iowa Civil Rights Commission within
60 days of the date of this decision.
3. IT IS FURTHER ORDERED that Prudential shall pay Complainant's attorney fees in an amount of $5,000.00 and costs in the amount of $656.55.
