NOTE: This decision was appealed to the Polk County District Court by the complainant after her application for rehearing was denied. On February 22, 1994, the court remanded the case to the Commission because the final decision lacked findings of fact and conclusions of law. On May 26, 1994, the Commission voted, on remand, to adopt the proposed decision originally issued on December 29, 1992. Respondent's application for rehearing was denied on June 24, 1994. Respondent filed a petition for judicial review with the Franklin County District Court. On April 5, 1995 the Court rendered an opinion affirming the Commission's decision.
